Terms of Service:

1. Introduction

By enrolling in any online course (“Course”) offered by Birdcage Group Pty Ltd or its subsidiaries (“Company”, “we”, “us”, “our”), you (“you”, “your”, “User”) agree to be bound by these Terms of Service (“Terms”). If you do not accept these Terms, you are not authorized to use or access the Course.

2. Intellectual Property Rights

All intellectual property rights in the Course materials, including texts, graphics, logos, images, software, and any other content, are owned by the Company or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and view the Course content for personal, non-commercial use only. Any other use, including reproduction, modification, distribution, or republication, without prior written consent from the Company, is strictly prohibited.

3. Disclaimer of Warranties

The Course and its content are provided “as is” without warranty of any kind, either express or implied. The Company disclaims all warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Course will meet your requirements or be available on an uninterrupted, secure, or error-free basis.

4. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Course; (b) any conduct or content of any third party on the Course; or (c) unauthorized access, use or alteration of your transmissions or content.

5. Use of Student Work and Testimonials

By enrolling, you grant the Company a perpetual, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display any submission you make in relation to the Course and your name and likeness for any purpose, including promotional. You also grant us the right to use your testimonials and feedback for promotional purposes.

6. Money Back Guarantee

Users who are dissatisfied with the Course and have not accessed, downloaded, or otherwise utilised any “tools” or “template” which are proprietary materials provided and the download of which the company cannot control, may request a full refund within forty-eight (48) hours of purchase, subject to the terms specified. Accessing any downloadable or saveable materials negates eligibility for a refund or cancellation under this guarantee. If you find that the training library does not meet your satisfaction and you have not accessed, downloaded, or otherwise utilised any tools, templates, or other proprietary materials (“Materials”) provided therein, you may submit a written request for the full reimbursement of any fees paid (“Refund”) and the immediate cancellation of any future scheduled payments (“Cancellation”) to [email protected] within forty-eight (48) hours of your initial purchase.

7. Refunds

Beyond the Money Back Guarantee, refunds are not provided except as required by Australian Consumer Law. 

8. Payment Plans and Subscription Details

Full Library™ Yearly Membership

  • Upfront Payment Option: Users may opt to pay the full amount for yearly access to the Full Library Membership, which will automatically renew each year unless cancelled by the user.
  • Monthly Installments Option: Alternatively, users can choose to pay for their yearly membership in monthly installments. Please note the Full Library purchased on it’s own constitutes a minimum 12-month commitment from the date of purchase, and Coaching Unlimited constitutes a minimum 6- month commitment from the date of purchase.
    • Cancellation of Installments: In the event you wish to cancel your payment plan, please email [email protected] after the minimum term and we can arrange for your account to be cancelled prior to the next billing date. Please note, we cannot cancel any accounts prior to the minimum term as listed above.                                                 
    • Payment Failure: In the event a scheduled payment cannot be processed (e.g., due to insufficient funds), the membership status will be marked as “Past Due.” We will attempt to capture the outstanding payment through Thinkific Payments. If the payment is not successfully processed within three weeks from the original renewal date, the membership or payment plan will be automatically cancelled, and the status will change to “Cancelled.”
    • Reactivating Membership: Users can manually attempt to re-run the failed payment via their Billing settings in their profile to restore access to the membership.

9. Specific Programs

Coaching Unlimited™ Upgrade 

  • Coaching UnlimitedTM provides Users with the ability to book one-on-one coaching sessions with Birdcage CertifiedTM marketing and business experts over a 6-month period, covering a wide range of topics including: 
    • Marketing Coaching: Strategy, Content, Social Media, Email Marketing, Paid Ads, Websites, Branding, Copywriting
    • Business Coaching: Sales, Product & Pricing, Client Management
    • Mindset + Focus Coaching          
  • Users are entitled to book up to 20 hours of coaching during this month period, which can be utilised as follows:
    • 60-minute, 40-minute, and 20-minute Teams or Phone calls
    • 20-minute Voxer voice note sessions
  • Booking and Rescheduling:
    • Booking: Coaching sessions can be booked between 6 hours and 14 days in advance.
    • Rescheduling: Sessions can be rescheduled up to 48 hours in advance without penalty. If a session is not rescheduled within the timeframe and you are unable to attend, the session will be counted towards your total hours. 
    • No-shows: More than 2 no-shows will result in all future sessions being forfeited, with no refunds provided.
    • Availability: While we strive to be as available as possible to best support you, we do not guarantee that your preferred coach or session time will be available. Coaches are primarily based in AEST time zones, with some in NZST and GM+1 (UK) time zones, and are available during business hours.  

10. Chargebacks

To protect against fraudulent chargebacks, we strongly discourage users from initiating chargebacks through their bank or credit card company. In the event of a chargeback, the user will be immediately removed from the course and barred from future enrollment, with no refunds provided.

We encourage users to contact us directly at [email protected] with any billing issues or disputes prior to initiating a chargeback. We are committed to resolving such matters fairly and promptly.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Australian courts.

12. Changes to Terms of Service

We reserve the right to modify these Terms at any time. Changes take immediate effect upon posting on our website. Your continued use of the Course signifies your acceptance of any adjustments to these Terms. 

13. Entire Agreement

These Terms constitute the entire agreement between you and the Company regarding the Course and supersede all prior agreements and understandings, whether written or oral, concerning its subject matter.
